Services outside the agreed scope may be quoted separately and will only be undertaken with the charity’s agreement.
Kola does not guarantee that every service listed in the Programme description will be required or included in the final project.
7. Website Development
Where website development forms part of the Programme, Kola will work with the selected charity to plan, design and develop a new website.
The charity will be responsible for providing information, text, images, branding, logos and other content required for the website unless otherwise agreed.
The charity is responsible for ensuring that all content it provides to Kola is accurate and that it has the necessary rights and permissions to use that content.
Kola will make reasonable efforts to deliver the website in accordance with the agreed project plan and specifications.
8. Hosting
The Programme includes up to one year of website hosting for the new website, subject to the agreed project scope.
Hosting is provided for the website developed as part of the Programme and does not automatically include hosting for other websites, applications, email services or third-party systems.
At the end of the included hosting period, the charity may be offered the opportunity to continue hosting with Kola under a separate agreement.
Any ongoing hosting fees following the included period will be communicated to the charity before the end of the Programme.
9. Website Maintenance & Support
The Programme includes website maintenance and support for one year, subject to the agreed scope.
This support is intended to cover reasonable website maintenance, updates and technical assistance.
It does not automatically include major redesigns, new functionality, extensive content creation, third-party software costs or work outside the agreed scope.
Kola will agree reasonable support arrangements and response times with the selected charity.
10. Charity Responsibilities
The selected charity agrees to:
- Appoint a suitable contact person for the project.
- Provide information and materials required by Kola in a timely manner.

Delays in providing information, content, feedback or approvals may affect the project timeline.
11. Project Timeline
Kola will agree a project timeline with the selected charity following selection.
The timeline may be adjusted where reasonably necessary due to changes in scope, delays in receiving materials or feedback, technical issues or other circumstances outside Kola’s reasonable control.
Kola will communicate significant changes to the project timeline with the charity.
12. Third-Party Services and Costs
The Programme covers Kola’s agreed services up to the stated value of €10,000.
Third-party services, subscriptions, licences, software, stock photography, fonts, plugins, domain registration, premium tools or other external costs may not be included unless expressly agreed as part of the project.
Where additional third-party costs are required, Kola will discuss these with the charity before they are incurred.

Unless otherwise agreed in writing, ownership and licensing of the website, designs, code, content and other materials created as part of the Programme will be discussed and agreed as part of the project.
The charity retains ownership of its existing intellectual property, including its name, logo, branding, content, images and other materials supplied by the charity.

It cannot be exchanged for cash, transferred to another organisation or redeemed for an alternative cash payment.
18. Data Protection
Kola will process personal information provided through the application process in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR) and applicable Irish data protection law.
Personal information will be used for purposes including administering the Programme, assessing applications, communicating with applicants and managing the selected project.
Applicants should not provide unnecessary personal or sensitive information as part of their application.
Further information about how Kola processes personal data should be provided in Kola’s applicable Privacy Policy.
19. Liability
Kola will provide the Programme services with reasonable care and skill.
To the extent permitted by law, Kola will not be responsible for losses arising from circumstances outside its reasonable control, including failures or interruptions affecting third-party hosting providers, software providers, domain registrars or other external services.
Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited under applicable law.
20. General
These Terms, together with any agreed project scope or separate agreement between Kola and the selected charity, form the basis of participation in the Programme.
If there is any conflict between these Terms and a separate written agreement relating specifically to the selected charity’s project, the separate agreement will take precedence to the extent of that conflict.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
21. Governing Law
These Terms are governed by the laws of Ireland.
Any disputes arising in connection with the Programme will be subject to the jurisdiction of the Irish courts, unless otherwise required by applicable law.
